Terms of use

1. General

 

These Terms of Use ("Terms") apply to use of the Mobietu mobile stamp card app (the "Service"). The Service is delivered and operated by More Mobile Relations Finland Oy, business id 25197225, Erottajankatu 9 A, 00130 Helsinki, Finland (the "Service Provider"). The seller of goods (the Business) using the Service to offer loyalty service for their customers and the Service Provider may hereafter be referred to as a Party or collectively or the "Parties".

 

The Terms are applicable to anyone using the Service (“User” or “you”).

 

By accepting the Terms, you agree to be bound by the Terms, and to follow them. If you do not agree, remove the Service application from your device and do not use the Service.

 

The Service involves processing of personal data about Users. Please see the Privacy Policy below for information on how we treat your personal data.

 

2. Registration

 

To be able to use the Service, you will need to register an account.

 

The Service cannot be provided without your submission of your correct email address for the application.

 

You must be at least 18 years old to register an account. It is your responsibility that the information registered is correct and updated. Note that you are responsible for all use of your account, whether authorized or not.

 

In the event of erroneous notifications or other information not addressed to you, you have the obligation to immediately delete such information and to contact the Service Provider. You do not have the right to use or store such information for your own purposes or to forward it to third parties.

The Parties reserves the right to shut down your account or take other measures to prevent misuse of your account. In such case you will be notified.

 

The Service is provided to you free of charge for your personal use and you can earn loyalty benefits from the Businesses.

 

 

3. Intellectual property rights

 

The Service contains copyrighted material, trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile the Service application nor can you create any derivative works or other works that are based upon or derived from the Service application in whole or in part.

All content, materials and data to which you obtain access by use of the Service, including but not limited to names, logos, trademarks, text, pictures, etc. belongs to the Business and/or the Service Provider.

 

4. Use Restrictions

 

You shall use the Service application in compliance with all applicable laws and not for any unlawful purpose.

 

You are responsible for misuse of the Service. Such misuse includes, but is not limited to:

 

  • Use of another person’s email address;

  • Use of another person’s phone or other tool to use the Service;

  • Logging or attempting to log in on someone else’s credential;

  • Registering another person without consent.

 

The User undertakes not to use the Service for sending messages that:

 

  • violate applicable law;

  • in any way constitute infringement of the Business’ or the Service Providers' copyright or other;

  • intellectual property rights or violate rules of integrity, public access or other rights;

  • are in any way offensive, abusive, threatening, obscene, is of racial, sexual or erotic nature, or which according to our assessment is not consistent with our ethics policy.

 

5. Limitations of liability

 

The Service Provider endeavors to ensure that the Service are fully operational. However, due to the nature of the internet, it cannot be guaranteed that the Service are free from delays, interruptions or errors. The Service Provider is not responsible for any charges for goods etc. if the use of the Service results in data or equipment needing to be replaced. The Service is presented without any guarantee of accuracy, reliability and completeness. This applies to material, services, software, text, graphics and links.

 

 

Responsibility for content

The Service Provider takes no responsibility for mistakes in content provided by the Businesses e.g. typos, outdated benefit rules, delayed or lost messages and orders

 

The Service Provider endeavors to ensure that the information in the Service is accurate and current at time of publication, but the Service Provider makes no warranties (explicit or implied) as to the reliability, accuracy and completeness of this information. We disclaim any responsibility for any direct, indirect or consequential loss or damage arising from the use of the Service, including any actions taken in reliance on any information appearing on these.

 

6. Actions taken to prevent misuse

 

The Service Provider has the right to take all necessary actions, including shutdown, deletion and removal of material, if the User violates the Terms, applicable law or if it is impossible to verify the registration of the User.

 

7. Changes to the Terms and the Service

 

The Service provider has the right to at any time make changes to the Service and / or these Terms for any reason. You will always find the latest version of the Terms here. If you disagree with a change, you must stop using the Service.

 

 

8. Waiver

 

If the User violates these Terms and the Service Provider takes no action, it shall not operate or be construed as a waiver of any other or subsequent breach.

 

9. Miscellaneous

 

If any of the Terms is deemed invalid, void or for any other reason unenforceable, that condition shall be deemed separate and shall not affect the validity and enforceability of any remaining terms and conditions.

 

10. Applicable law and jurisdiction

 

This Agreement shall be governed by the law of the Finland applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Finland therefrom.

Privacy policy

 

The Service provider uses cookies and other methods to gather statistics on visitor traffic. A cookie is a small text file sent to the customer’s browser, which usually contains an anonymous identifier. Cookies will not damage your terminal.

 

The Service Provider uses cookies to gather visitor statistics and detailed data on the use of our website. We use such data to help us present issues and themes of interest to our customers. The Service Provider may also use data gathered using cookies and other methods to target content at customers. The Service Provider does not forward the personal data of its customers or website users to third-party advertising networks.

 

The customer has the option of blocking cookies by changing the browser settings.

3. Purpose of using personal data

 

The personal data is used to provide benefits to customers, marketing communication, customer analysis, development of the Service, new services and business.

 

4. Content of register

 

All of the following data recorded on the register may be processed:

 

first name and surname

contact information (postal address, telephone number and email address)

the start and end dates of customer contacts and/or relevant contacts, and method how of these started or ended

direct marketing permits and bans

data on the use of digital services and content (e.g. ordering of newletters), metadata concerning the data subject’s browser and sent to the controller’s server (e.g. IP address, browser program, browser version, page from which the data subject visited our website), as well as cookies sent to the data subject’s browser and cookie-related data

information related to marketing or sales promotions, such as marketing measures targeted at the data subject, and participation in such marketing (e.g. participation in promotional prize draws and competitions, and events)

data related to the management and maintenance of customer contacts and other related contacts (e.g. data on the purchase and cancellation of payable products and services, data on free-of-charge product and service orders, delivery information, feedback, complaints, as well as recordings of customer service interactions such as telephone calls, emails, and chat and text messages)

matters of interest indicated by the data subject

the language used

data on changes made to the data listed above

Data generated by analysing service use or other data provided by the customer, e.g. possible subjects of interest.

In addition to the above-mentioned data, the following register data on a product and/or service purchaser may be processed:

customer code

invoicing and debt-collection data

 

5. Regular data sources

 

Personal data on the data subject is gathered from the data subject themselves, from various services used by the data subject (e.g. the Service web-site and social media channels) as well as various marketing measures in relation to activities such as promotional prize draws, competitions and events.

 

In addition, personal data can be collected and updated from public authorities and companies providing services that involve personal data.

 

6. Handover and transfer of data

 

The controller will not hand over the customer’s personal data to third parties.

 

7. Protection of register

 

The data included on the digital register is protected by firewalls, encryption, passwords and other technical means generally accepted in the sector. Manually maintained material is located on premises subject to controlled access.

 

Only pre-identified employees working for and assigned by the controller, or working for companies acting on behalf of the controller, have access to data on the register, on the basis of user rights issued by the controller.

 

9. Right of access, restriction of processing and rectification

 

According to the Personal Data Act, data subjects have the right of access to information, to check on what data pertaining to them has been recorded in the register. Upon the request of the data subject, we will make any necessary rectifications and additions to the personal data or, with regard to the purpose of processing the data, erase any erroneous, unnecessary, incomplete or outdated data. To check and update data, contact the above-mentioned person in charge of register-related matters.

 

Data subjects have the right to object to the processing and handover of data concerning them direct advertising, distance selling and other direct marketing, as well as market survey and opinion-polling purposes.

 

10. Amending the privacy policy

 

The Service Provider continuously develops its business operations and therefore reserves the right to make changes to this privacy policy. Changes may also be made on the grounds of legislative amendments.
